The Office of the New Mexico Attorney General oversees charities (except for religious and educational organizations) that exist, operate or solicit contributions in this state.  All 501(c)3 and other organizations which hold themselves out as having a charitable purpose must register with the Attorney General's office and file annual financial reports.

The Assistant Attorney General, Elizabeth Korsmo will present the statutory requirements as defined in New Mexico under the Charitable Solicitations Act and demonstrate the registration process using NM-COROS, the NM Charitable Organization Registration Online System.

Learning Objectives

  • Know what legal responsibilities are assumed by a charitable organization which exists, solicits or operates in New Mexico under the Charitable Solicitations Act
  • Know the registration and reporting requirements enforced by the Attorney General
  • Have the ability to enter information into the NM-COROS system

Level
Introductory/Intermediate: for any nonprofit staff or volunteer responsible for registering their charitable organization and filing annual reports with the NM Attorney General's Office.

Presenter
Elizabeth Korsmo became the head of the Charities Unit of the Attorney General's Office in November of 2009 in a continuation of her public service career.  Since then, the registration and reporting requirements for charitable organizations have been transferred from an obsolete hard copy form to an electronic system and the AG's Office now has 5,000 chartiable organizations registered electronically.  Ms. Korsmo is a member of the National Association of State Charity Officials (NASCO) and is leading 40 states and the Federal Trade Commission in a multistate action to stop and deter charitable fraud.  She has spoken on the subject at Columbia Law School Charities Project and at multiple NASCO conferences.
